SCJN ratifies dismissal of Isidro Avelar Gutiérrez, magistrate linked to the CJNG

Mexico City.- The Supreme Court of Justice of the Nation (SCJN) ratified the dismissal of magistrate Isidro Avelar Gutiérrez who has been facing charges since 2019 for alleged illicit enrichment and apparent ties to the Jalisco Nueva Generación Cartel (CJNG) and its armed wing “Los Cuinis”.
Through the judicial lists, it was reported that the ministers of the SCJN ratified in a private session last February the decision made by the Federal Judicial Council (CJF) in November 2021.

At the time, Minister Arturo Zaldívar served as president of the Judiciary, an institution that formally filed a complaint with the Attorney General of the Republic (FGR) derived from “patrimonial irregularities and additional income”, derived from the sale of an address in the municipality of San Pedro Garza García, in Nuevo León.
Once he was denounced, elements of the FGR arrested Avelar Gutiérrez and brought him before a judge and linked to the process. Subsequently, he was sentenced to preventive detention, in which he remained for two years until in 2022, as a result of his appeals, he was able to continue his process out of jail.

A year later, just last July, he was acquitted of this accusation by federal judge Daniel Ramírez Peña, who has also been accused by the federal government of having released alleged members of organized crime for minor reasons.
Prior to that ruling, in September 2022, the magistrate asked the SCJN to analyze his dismissal, which was finally ratified by the ministers of the High Court.

In addition to this process, Isidro Avelar Gutiérrez is also accused by the United States Department of Justice of having received alleged bribes from the criminal organization led by Nemesio Oseguera Cervantes “El Mencho” and his armed wing known as “Los Cuinis”.
